MDC Litigation Trust Files 17 Clawback Lawsuits in MTE Holdings, LLC

November 5, 2021, District of Delaware – Plaintiff RPA Asset Management Services, LLC, as Trustee of the MDC Litigation Trust, brings complaints against seventeen (17) creditors to avoid and recover all preferential transfers of property allegedly made by the debtors to or for the benefit of the defendants during the ninety (90) day period before the commencement of the debtors’ Chapter 11 cases pursuant to 11 USC §§ 547 and 550.

On October 22, 2019, MTE Holdings filed a voluntary petition for relief under Chapter 11 of the United States Bankruptcy Code. On October 23, 2019, MTE Partners and Olam filed voluntary petitions for relief under Chapter 11 of the United States Bankruptcy Code. Finally, on November 8, 2019, MDC Energy LLC, MDC Reeves Energy LLC., MDC Texas Operator LLC, and Ward I, LLC filed voluntary petitions for relief under Chapter 11 of the Bankruptcy Code. All cases are jointly administered under Cause No. 19-12269. 

Creek Pipe Company, LLC., Total Energy Solutions, LLC., United Casing Incorporated, Stallion Oilfield Holdings, Inc., are some of the largest creditors against whom Plaintiff has initiated clawback actions. The Rosner Law Group L.L.C. represents the Trustee, and Honorable Judge Craig T Goldblatt is overseeing the debtors’ bankruptcy cases.
