LQD Business Finance & Others Move for Summary Judgment Against Mockoviaks’ Clawback Claims
November 15, 2021, Southern District of Florida – Defendants LQD Business Finance, LLC, LQD Loans Two, LLC, and George Souri file a motion for summary judgment on the second amended complaint of the Debtor Plaintiffs Robert J. Mockoviak and Sandra H. Mockoviak to recover transfers worth $7.5M as “preference and fraudulent conveyances”.
The complaint claims that Mockoviaks “vilified” and “maligned” the Defendants to cover their own misdeeds and avoid liability on valid business debts for admitted material breaches of loan agreements. The Defendants further claims that no record evidence could conceivably support Mockoviaks’ principal theories of liability that LQD was engaged in a “loan to own scheme” or that Souri “intentionally interfered” with clinical trial contracts. Accordingly, the Defendants allege that the Plaintiffs lack standing to pursue claims.
