JPR Mechanical Trustee Initiates 41 Lawsuits to Clawback About $7.1 Million as Alleged Preferences and Fraudulent Conveyances
August 9, 2021, Southern District of New York – Plaintiff Trustee Marianne T. O’Toole, for the estate of J.P.R. Mechanical Inc. d/b/a JPR Mechanical (“Debtor”) initiates about forty-one (41) adversary proceedings to avoid and recover alleged transfers of interest of the Debtor’s property during the 90 days before the petition date as “preference transfers”. The Trustee also seeks to avoid and recover any transfers by the Debtor that may have been “fraudulent conveyances” under sections 548 and 550 of the Bankruptcy Code and seeks to disallow any claims against the Debtor’s estate according to section 502(d) of the Bankruptcy Code.
The largest cases in the group were filed against Anvil Mechanical Inc., Five Star Electric Corp., International Asbestos Removal, Inc., A.D.E. Systems, Inc., for a return of $1256333.99, $612929.6, $585500, and $517500 respectively. The case is In re JPR Mechanic, Inc., Case No. 19-23480-RDD in the United States Bankruptcy Court for the Southern District of New York. The Trustee is represented by the law firm of LaMonica Herbst & Maniscalco, LLP. Honorable Judge Robert D. Drain is overseeing the Debtor’s bankruptcy case.
