Debtor Alleges Non-Payment by Alleged “Alter-Ego” Entities and Sues Principal

September 14, 2022, US Bankruptcy Court for Northern Georgia – Keys Medical Staffing, LLC (“Keys” or “Debtor”) files a complaint against SavaSeniorCare LLC (“Sava”), SSC Equity Holdings LLC, et al., for the award of damages in the amount of $969,148.38 due to an alleged breach of contract.
The crux of this case is the staffing agreement signed between Keys and each of the alleged “alter-ego” companies of Sava. Keys had allegedly agreed to provide temporary personnel services to the alleged “alter-ego” companies under the agreements and in exchange, the companies allegedly agreed to pay Keys for those services.
However, later Keys allegedly assigned its contractual right to receive payment under the staffing agreements to one of its creditors, ARA Inc. The Debtor claims that the alleged “alter-ego” companies were notified of the alleged assignment of right. The Debtor, therefore, alleges that the alleged “alter-ego” companies were allegedly obligated to pay ARA under the staffing agreements but the companies allegedly did not do so.
The Debtor alleges that the alleged “alter-ego” companies allegedly “breached” their staffing agreements by allegedly failing to pay invoicing totaling $969,148.38. The Debtor pleads for damages for the alleged “breach” from the alleged “alter-ego” companies and their principal, Sava.
