DirectStream Federal Trustee Eyes Over $500K in “Clawback Actions”

March 7, 2022, Middle District of North CarolinaDon A. Beskrone, Chapter 7 Trustee for the bankruptcy estate of DirectStream, LLC, initiates lawsuits against nine defendants to avoid and recover alleged “preferential” and “fraudulent transfers” totaling $564,280.97 and to “disallow any claims held by the defendants”.

As gathered from the court filings, before filing for bankruptcy, Debtor owned and operated a business that designed secure FPGA (field-programmable gate array) computation and networking and provided general purpose reconfigurable computing and programmer-friendly servers, workstations, and embedded systems. On March 5, 2020, the Debtor filed a “voluntary petition” under Chapter 7 of the Bankruptcy Code.

American Express Company, United Healthcare, and GPIF CO Springs LLC are some defendants sued for return of transfers. The law firm of Ricardo Palacio, Esq Ashby & Geddes, PA, is representing the Trustee and Bankruptcy Judge Mary F. Walrath presides over the DirectStream LLC’s bankruptcy case. The case is In re DirectStream, LLC, Case No. 20-10534 (MFW).
