About $1 Million Sought from Wise Services in Q’Max America, Inc. 

October 4, 2021, Southern District of Texas – Trustee Christopher R. Murray for the bankruptcy estates of Q’Max America, Inc. and Anchor Drilling Fluids U.S.A., L.L.C. files a complaint against Wise Services, Inc. to recover about $1 million with allegations of breach of contract, quantum meruit, unjust enrichment, fraudulent misrepresentation, and inducement 

The Trustee claims that at least $1,106,406 is due back to the estate under 11 U.S.C.§ 542(b) because “Wise owes this amount to the estate”, and the debt due from Wise to the Trustee “is property of the estate”. Accordingly, the Trustee seeks to turn over the amount “improperly invoiced and accepted” from the estate under 11 U.S.C. § 542(b) because the Trustee claims that it is a material asset and is of substantial value to the estate.
