Florida Court Grants Defendants’ Motion to Dismiss Complaint That Alleged Conspiracy for Financial Gain

August 10, 2021, Middle District of Florida – The United States District Court for Middle District of Florida grants Defendant Apax Partners LLP and its CEOs Andrew Sillitoe and Mitch Truwit’s motion to dismiss the complaint about failure to state a claim. Plaintiff had alleged unfair trade practices by Defendant Apax as part of a conspiracy with the other defendants for financial gain and expansion of a company as racketeering activity. Plaintiff alleged that he was injured in his business and property in the form of lost compensation and emotional harm as a “direct result” of the predicate acts. The Court dismissed Plaintiff’s complaint, holding those vague allegations of a conspiracy for financial gain does not show how a consumer would be deceived by an investor, nor how an investment would directly harm the plaintiff “in his business.”
