Trustee Janet Haigler Sues ESB Holdings To Avoid Alleged “Fraudulent Transfers” in Callahan Grading Bankruptcy

December 6, 2021, District of South Carolina – Trustee Janet Haigler for the bankruptcy estate of construction company, Callahan Grading, LLC, initiates a legal action ESB, Holdings, LLC, to recover money or property for the benefit of the estate by setting aside alleged “fraudulent conveyances.”

The complaint states that Callahan Grading allegedly transferred about $418,560.00 to ESB within the two years before the former filed for bankruptcy and allegedly received no consideration in exchange for the said transfers. In its complaint, Haigler contends that Callahan Grading’s insiders allegedly “owed money” to ESB, and the transfers at issue were allegedly made for the benefit of “the insiders” and not for the benefit of Callahan Grading.

Accordingly, the Trustee requests the Court to avoid the said transfers as alleged “fraudulent conveyances” under § 548 of the Bankruptcy Code.
