Bluewater Toxicology and Others Move to Dismiss Curare Laboratory’s $5.3M Clawback Lawsuit

November 18, 2021, Western District of Kentucky – Defendants Jennifer Bolus, Bluewater Toxicology,  LLC and  Solar Holdings Group, LLC, file a motion to dismiss Debtor Curare Laboratory, LLC’s complaint for “lack of jurisdiction” and for “failure to state a claim” for which relief can be granted. 

The Defendants claim that the property at issue is not the property of the Debtor’s estate, and therefore, the Court “lacks jurisdiction”. The Defendants further assert the issues raised in the complaint regarding the transfer of funds are from one non-debtor to another non-debtor and therefore “were not the Debtor’s property”. Accordingly, the Defendants allege that the complaint fails to set forth plausible claims.
